Abramson Labor Group is seeking an experienced Trial Representative to support our Workers’ Compensation practice. This individual must be based in or near San Jose, CA and will be responsible for attending and handling trials throughout San Jose and the surrounding areas. The ideal candidate will have a strong background in Workers’ Compensation litigation, including trial appearances, negotiation of settlements, handling QME evaluations, and preparing settlement documentation.

Key Responsibilities 

  • Prepare files for trial including client preparation, strike process, determining trial posture, and filing all required pleadings.  

  • Represent clients at Workers’ Compensation trials and hearings in San Jose and the surrounding areas.  

  • Review and evaluate QME/AME reports to determine case strategy and trial readiness. 

  • Negotiate settlements with opposing counsel and defense representatives. 

  • Collaborate with internal attorneys, case managers, and support staff to ensure thorough case preparation and client advocacy. 

  • Maintain detailed records of case activities, trial outcomes, and negotiations. 

  • Provide strategic guidance to the legal team based on trial results and trends. 

  • Maintain case file data entry and workflows to ensure compliance with internal procedures. 

  • Minimum of 2-3 years of experience in Workers’ Compensation law, with direct trial experience required. 

  • Strong knowledge of California Workers’ Compensation procedures and regulations. 

  • Experience reviewing and interpreting QME/AME reports. 

  • Demonstrated ability to negotiate favorable settlements. 

  • Experience preparing and finalizing settlement documentation. 

  • Excellent written and verbal communication skills. 

  • Must be highly organized, detail-oriented, and comfortable working independently. 

  • Ability to travel to various Workers’ Compensation Appeals Board (WCAB) locations in the CA Bay Area as needed.
